A North Aurora man has received a sentence of eight years in prison as part of a plea deal related to an alcohol-influenced accident which resulted in the death of a motocyclist in Batavia last year.
This morning, Kane County State’s Attorney Jamie L. Mosser announced that 40-year-old Luis Aca Osorio agreed to the sentence in exchange for a guilty plea to the offense of aggravated driving under the influence of alcohol – causing death, a Class 2 felony.
Judge Julia Yetter accepted the plea.
Prosecutors asserted that on May 7, 2023 at approximately 5:15pm, the defendant was driving a van in Batavia when he rear-ended a motorcyclist who was driving in front of him. The defendant stopped a short distance away from the crash where he was located by officers and believed to be impaired. He ultimately submitted to a chemical breath sample which showed his breath alcohol concentration to be 0.204.
The driver of the motorcycle was pronounced deceased as a result of the injuries he sustained from the crash.
“This entirely preventable traffic crash is another reminder that drinking and driving cannot only happen at any time of the day, but that it can have fatal consequences,” said Assistant State’s Attorney Katy Flannagan. “Driving Under the Influence will not be tolerated in Kane County, and I believe that this negotiated sentence sends that message clearly.”
In accordance with Illinois law, Aca Osorio must serve 85 percent of the sentence. He received credit for 24 days served in the Kane County jail. The sentencing range for this offense is between three to 14 years of imprisonment in the Illinois Department of Corrections.
