Elgin Man Sentenced To Eight Years For Repeatedly Sexually Assaulting Middle School Student

A 27-year-old Elgin man was sentenced to eight years in prison after being found guilt of repeatedly sexually assaulting a Streamwood middle school studemt.

Kane County State’s Attorney Jamie L. Mosser announces that Judge Barsanti has sentenced Magdiel Perez to eight years of imprisonment in the Illinois Department of Corrections.

On April 11, Perez was found guilty of two counts of the offense of Criminal Sexual Assault, Class 1 felony, following a bench trial.  

According to evidence presented at trial, on more than one occasion between May 1, 2022 and August 30, 2022, Perez sexually assaulted the victim, a student at Streamwood’s Tefft Middle School at the time of the offense. At the time, Perez was employed as a hall monitor at the school. On more than one occasion, Perez drove the victim to his home in Elgin and sexually assaulted her. As soon as this victim disclosed these acts, officials at Tefft Middle School contacted the Department of Children and Family Service and placed the defendant on administrative leave. 

Criminal Sexual Assault is subject to a mandatory prison term of between four and 15 years in the Illinois Department of Corrections. In accordance with Illinois law, each term of imprisonment must be served consecutively. The State requested a term of imprisonment totaling 16 years in the Illinois Department of Corrections at a sentencing hearing. The judge imposed a sentence totaling eight years in the Illinois Department of Corrections, the minimum sentence in this case.

In accordance with Illinois law, Perez must serve at least 85 percent of the sentence. Perez receives credit for three days served in the Kane County Jail. In addition to the prison term, Perez must register for life as a sexual offender in accordance with the Illinois Sexual Offender Registration Act. Perez had been free on $20,000 bond until the entry of his sentence.

“As a society, we expect for our children to be able to trust the adults working at their school,” said Assistant State’s Attorneys Stacey Wittman after the sentencing. “This defendant took advantage of this student’s trust and sexually assaulted her. I am thankful to this victim for her willingness to face her abuser in court.”
