An apparent drug deal at the Clock Tower Plaza went wrong Saturday afternoon, resulting in a struggle during which a firearm was discharged.
Two men have been charged in the incident.
At approximately 1:22 p.m. on Saturday, Elgin police responded to the Clock Tower Plaza for a report of shots fired. Upon arrival, all subjects known to be involved in the incident were quickly located and detained, including an individual who fled on foot and was found to be in possession of a firearm. All subjects were taken into custody without incident and transported to the Elgin Police Department.
Upon further investigation, it was determined that the individuals detained had been involved in a drug transaction. One of the subjects involved in the incident brought an accomplice and provided him with a firearm. The subject who provided the firearm possessed a valid FOID and Concealed Carry License.
While two of the subjects were meeting to conduct the drug transaction, the subject with the firearm approached the meeting and struck one of the individuals in the head with it. A struggle ensued over the firearm during which the weapon was discharged.
There were no reported injuries due to the firearm being discharged, but one of the subjects sustained what is believed to be a non-life-threatening head injury as a result of being physically struck with the firearm.
The Kane County State’s Attorney’s Office have charged a 23-year-old Elgin man with:
-Three Counts (3) of AGGRAVATED UNLAWFUL USE OF WEAPON – PERSON/VEHICLE – PREVIOUS FELONY (Class 2 Felony)
- Unlawful Use Or Possession Of Weapons Or Ammunition By Convicted Felons (Class 3 Felony)Aggravated Battery (Class 3 Felony)
- Reckless Discharge Of A Firearm (Class 4 Felony)
- Mob Action (Class 4 Felony)\
- Battery Cause Bodily Harm (Class A Misdemeanor)
- Criminal Trespass To Vehicles (Class A Misdemeanor)
A second man, a 22-year-old resident of Chicago, was also charged:
- Aggravated Battery (Class 3 Felony)
- Mob Action Violence (Class 4 Felony)
- Reckless Discharge Of A Firearm (Class 4 Felony)
- Aggravated Unlawful Use Of A Weapon (Class 4 Felony)-Battery (Class A Misdemeanor)
The accused both appeared in Kane County bond call on October 31st, 2022, where their bonds were set at $75,000 (10% to apply) and $25,000 (10% to apply), respectively.
