During the evening of January 10, 2021, Brian Clemente and his girlfriend were at their Aurora home with their two young children. Clemente was intoxicated and angry, having learned that his girlfriend was romantically involved with someone else. He repeatedly asked her if he was the father of their 2-month-old daughter. His girlfriend then went to bed.
Clemente then took the infant from her bedroom and severely beat and kicked her, causing significant injuries. The child continues to recover from her injuries, although doctors do not know if she will fully recover.
As a result, the 28-year-old Clemente faces a possible 30 years in jail.
Kane County State’s Attorney Jamie L. Mosser announced today that Judge John A. Barsanti has found Clemente guilty of the offenses of aggravated battery to a child causing great bodily harm – Class X felony and aggravated domestic battery causing great bodily harm – Class 2 felony.
Clemente waived his right to a jury trial.
“Mr. Clemente failed at his most important responsibility, which was to care for his vulnerable children,” stated Assistant State’s Attorney Amanda Busljeta. “This infant depended on him to keep her safe, and not only did he let her down, he egregiously inflicted injuries that were so severe she might never recover from them. My thanks to ASA [Jessica] Finley, to victim advocate Martha Martinez, to the Aurora Police Department and specifically Det. Jennifer Hillgoth, and to the medical personnel at Rush University Medical Center and Loyola University Medical Center for saving this little girl’s life.”
Judge Barsanti set Clemente’s next court appearance for 1:30 p.m. July 21, 2022, in Courtroom 319 at the Kane County Judicial Center for motions and sentencing. Clemente faces a maximum sentence 30 years of imprisonment in the Illinois Department of Corrections.
Clemente remains in custody at the Kane County jail, where he had been held in lieu of $1 million bail since his arrest. Judge Barsanti granted the state’s request upon conviction and revoked Clemente’s bond.
