34-year-old Fabian J. Torres has agreed to a sentence of 38 years of imprisonment in the Illinois Department of Corrections in exchange for a guilty plea to the offenses of aggravated criminal sexual assault, Class X felony, and attempted murder, Class X felony, 2 counts.
Kane County Judge David P. Kliment accepted the plea.
Kane County Assistant State’s Attorney Bill Engerman stated in court that on April 8, 2019, Torres entered a home in the 900 block of Saratoga Drive, Sleepy Hollow, Ill., without permission and carrying two knives. He then sexually assaulted the female victim who lived in the residence and stabbed her multiple times, causing serious injuries. A male relative who lived in the home came to her aid. Torres stabbed him multiple times on his body and face, causing serious injury that required hospitalization and surgery. Torres then fled the home. He was taken into custody a short time later. He admitted to police that he had committed the sexual assault and had stabbed both victims.
At the time Torres was on parole for a 2011 offense of attempted aggravated arson in McHenry County. He was released from prison in October 2018.
According to Illinois law, Torres must serve at least 85 percent of the sentence. He receives credit for 829 days served in the Kane County jail.
Engerman said “This is among the most violent and horrifying cases that I have encountered in my years as a prosecutor. Mr. Torres is a dangerous individual who belongs in prison, away from civilization. I want to send my thanks and best wishes to the victims and their family as they continue to recover from the physical and emotional scars of this encounter. My thanks to the Sleepy Hollow Police Department for its work in this case.”
Kane County State’s Attorney Jamie Mosser also commented. “The bravery that was shown by the two victims in this case is unimaginable given what they had to endure. My heart goes out to this family, which continues to heal after the depravity shown by this defendant. Our community is safer with Mr. Torres in prison. I would like to thank the Sleepy Hollow Police Department and the responding EMTs in this emergency for helping the victims and taking this dangerous individual into custody quickly.”
