A Montgomery man has pleaded guilty to sexually assaulting a child under the age of 13 on multiple occassions over an 18-month period.
Kane County State’s Attorney Jamie L. Mosser announced Friday that 40-year-old Gerardo Silva has agreed to a sentence of 26 years of imprisonment in the Illinois Department of Corrections in exchange for a guilty plea to the offense of Predatory Criminal Sexual Assault of a Child, a Class X felony (2 counts).
Judge Alice C. Tracy accepted the plea.
Between February 2020 and July 2021, Silva sexually assaulted the victim, whom he knew, on multiple occasions.
“This victim bravely came forward to talk about her ongoing abuse,” Assistant State’s Attorney Stacey Wittman said after the plea. “I am grateful for her courage and patience while this case has been pending.”
In addition to the prison term, Silva must register for life as a sexual offender in accordance with the Illinois Sexual Offender Registration Act.
In accordance with Illinois law, Silva must serve at least 85 percent of the sentence. He receives credit for 843 days served in the Kane County jail.
