    Elgin Man Indicted For Battery, Hate Crime In Carpentersville McDonald’s Beating

    A 19-year-old Elgin man has been indicted on a variety of charges ranging from Aggravated Battery to Hate Crime in connection with an incident that occurred May13 at a McDonald’s restaurant in Carpentersville.

    Kane County State’s Attorney Jamie L. Mosser and Carpentersville Chief of Police Todd Shaver announced Tuesday that the suspect has been indicted for Aggravated Battery (Great Bodily Harm), a Class 3 felony; Aggravated Battery (Public Place), a Class 3 felony; Aggravated Battery (Public Place), a Class 3 felony; Mob Action, a Class 4 felony; and Hate Crime, a Class 4 felony.

    Prosecutors allege that on May 13, a McDonald’s restaurant located at 1660 South Kennedy Drive in Carpentersville, the suspect, while acting with another person, struck and/or kicked a victim in the head and/or body, causing her great bodily harm. The acts were committed in a public place of accommodation and by reason of the actual or perceived sexual orientation of the victim.

    A juvenile (age 16) involved in the incident was also charged with a Hate Crime, in addition to Mob Action and Aggravated Battery charges. His identity is being withheld in accordance with state laws protecting minors’ privacy.

    “Like all cases we handle, my office filed these charges following a thorough investigation and an unbiased review of the facts,” Mosser stated. “These allegations are serious and will be prosecuted to the fullest extent of the law. Everyone deserves to feel safe in public spaces, and no one should be attacked because of their gender identity or sexual orientation, as is alleged in this case. We must make it clear that Kane County is a community that welcomes all.”

    The suspect is currently being detained in the DuPage County jail for separate, unrelated charges, and his next court appearance in Kane County will be June 27 at 9 am in Courtroom 319 at the Kane County Judicial Center.
