    Aurora Man Gets 7 Years In Prison For Violent Domestic Attack

    An Aurora man was sentenced to 7 years in prison after pleading guilty to charges of domestic battery.

    Kane County State’s Attorney Jamie L. Mosser announced that Jose E. Avila has agreed to a sentence of seven years of imprisonment in exchange for a guilty plea to the offense of domestic battery causing bodily harm, Class 2 felony.

    On the evening of January 17, 2023, Avila went to the home of his former girlfriend and their four children. While at the residence, Jose was drinking alcohol and the two were arguing. At about 12:45 the next morning the victim told Avila to leave the residence and pushed him toward the front door. Avila said he would not leave and stabbed the victim three times in the torso.

    Avila has four prior domestic battery convictions dating to 2006.

    “Mr. Avila’s actions were unjustified, horrific and demonstrative of the cycle of domestic violence and abuse,” said Kane County Assistant State’s Attorney Hannah Stout. “His mistreatment of the survivor escalated that day and the prison sentence shows the consequences of that escalation. I am grateful that this survivor stood up for herself and that I could help her in her efforts not only to bring Mr. Avila to justice, but also to bring some peace back into her life.”

    In accordance with Illinois law, Avila is eligible for day-for-day sentencing. Avila receives credit for 224 days served in the Kane County jail.

    Judge Elizabeth K. Flood accepted the plea.
