A Kane County jury found José A. Tamayo guilty of the offense of predatory criminal sexual assault, Class X felony, 3 counts, and aggravated criminal sexual abuse, 4 counts.
Between January 2018 and May 2019, Tamayo sexually assaulted two children younger than 13 years old. Tamayo knew both victims.
“I cannot say enough about the bravery shown by these two young victims, who were assaulted by someone who was in charge of their care,” said Assistant State’s Attorney Matthew Rodgers in a statement. “Their dedication to the truth means this defendant will not be able to abuse any other children. My thanks to the staff at the Kane County Child Advocacy Center, specifically ASA [Stacy] Wittman, Investigator Dave Smith and victim advocates Dawn Vogelsberg and Andrea Nava, who all went above and beyond in making sure that justice was served and that these children will be safe.”
Kane County Judge Salvatore LoPiccolo Jr. set Tamayo’s next court appearance for 1:30 p.m. on April 22, 2022, in Courtroom 211 at the Kane County Judicial Center for motions and sentencing. Tamayo faces a sentence of life imprisonment in the Illinois Department of Corrections. The life prison sentence is mandatory because Tamayo has been convicted of sexually assaulting multiple victims.
In addition to the prison term, Tamayo must register for life as a sexual offender pursuant to the Illinois Sexual Offender Registration Act.
Tamayo remains in custody at the Kane County jail, where he has been held in lieu of $250,000 bail since his arrest. Judge LoPiccolo revoked bond upon conviction.
