Kane County State’s Attorney Jamie L. Mosser and St. Charles Deputy Police Chief Rich Clark announced today that no criminal charges will be filed in the accidental death of a 5-year-old St. Charles boy that occurred on Tuesday, May 27.
After a review of the facts, Mosser determined that no charges will be filed.
“This was a heartbreaking and tragic accident that has devastated a family and deeply affected the community,” said State’s Attorney Mosser. “After a comprehensive review of the evidence, it is clear that this was not the result of criminal conduct, recklessness, or negligence. It was a moment that no family member of a loved one should ever have to experience. My heart goes out to everyone impacted by this tragedy, especially the family of this young boy. I would like to thank the St. Charles Police Department and the Kane County Accident Reconstruction Team for their thorough and professional investigation.”

A 5-year-old child was tragically killed Tuesday after apparently being struck by a vehicle in a driveway in St. Charles.
At approximately 5:09pm Tuesday, the St. Charles Police and Fire Departments were dispatched to a driveway in the 4000 block of Royal Fox Drive for a traffic crash in which a 5-year-old child had been struck.
Upon arrival, officers located a neighbor performing CPR on the child and immediately took over. Police and Fire continued to perform life-saving measures on the scene, and the child was ultimately taken to Northwestern Medicine Delnor Hospital, where he was pronounced deceased.
The driver of the vehicle was identified as an immediate family member and has been fully cooperative throughout the investigation.
The St. Charles Police Department is continuing to investigate the crash and has been assisted by the Kane County Accident Reconstruction Team (KCART).
