A exchange of gunfire between occupants of a moving vehicle and individuals walking on the sidewalk last Thursday resulted in felony charges against an adult and a juvenile in Elgin.
On December 29th at 3:26 p.m., officers responded to the 500 block of Lavoie Ave. for a report of shots fired.
Upon investigation, it was determined that the occupants of a vehicle discharged a firearm into the air after an argument with subjects who were walking on the sidewalk. One of the subjects who was walking on the sidewalk subsequently discharged a firearm at the vehicle.
After a review of the facts of the case by the Kane County State’s Attorney’s Office,and 18-year-old Elgin man was charged with the following:
- Reckless Discharge Of A Firearm (Class 4 Felony)
- Mob Action (Class 4 Felony)
- Possession Of Ammunition Without A Foid (Class A Misdemeanor)
- Possession Of A Firearm Without A Foid (Class A Misdemeanor)
Charges were also approved for a 16-year-old juvenile:
- Aggravated Discharge Of A Firearm (Class 1 Felony)
- Unlawful Use Of A Weapon-Not Eligible For A Foid (Class 3 Felony)
- Aggravated Unlawful Use Of A Weapon (Class 4 Felony)
The 18-year-old subject appeared in Kane County bond call on January 2nd, 2023, where he was released on his recognizance.
The juvenile was transported to the Kane County Youth Home.
