Seventy-three-year-old Willie Mosely of Maywood, Illinois, was just trying to help.
Mosley and another man were transporting a refrigerator in the back of their pickup truck this past Monday when it accidentally fell out the back on Eola Road in Aurora. Mosley and another man got out to put it back in the truck, along with the assistance of a good Samaritan who had stopped to help, when, it is alleged, a drunk driver crashed into him, pinning him against the truck and injuring the other two men.
Mosley was pronounced dead at a local hospital shortly thereafter.
The man traveling with Mosley sustained minor injuries and refused medical treatment. The man who pulled over to assist was taken to a hospital for medical attention where he remains in stable condition. The alleged drunk driver was transported to a local hospital for medical attention to minor injuries and was subsequently released to the Aurora Police Department pending charges. It is alleged that his BAC was .214 shortly after the crash.
On Friday, DuPage County State’s Attorney Robert Berlin and Aurora Chief of Police Keith Cross announced that bond has been set for the 29-year-old Geneva man, who has been charged with one count of Aggravated DUI Causing Death (Class 2 Felony), one count of Aggravated DUI Causing Great Bodily Harm (Class 4 Felony) and two counts of Misdemeanor DUI. Judge Michael Reidy set bond at $500,000 with 10% to apply.
“The complete disregard for the safety of the motoring public allegedly displayed by [the accused] as he operated a motor vehicle with a BAC nearly three times the legal limit will not be tolerated in DuPage County,” Berlin said. “Driving is a privilege, not a right and if the charges against [the accused] are proven true, he will face significant consequences. To the family and friends of Mr. Mosley, I offer my sincere condolences on their loss. I commend the Aurora Police Department for their work not only in this case but for their continued efforts in keeping our roadways safe. I thank the members of the Metropolitan Emergency Response and Investigative Team Major Crash Reconstruction Team for their work. I also thank Assistant State’s Attorneys Denis Cahill and Helen Kapas for their efforts in preparing a strong case against [the accused].”
“The Aurora Police Department has a zero tolerance when it comes to people driving under the influence of drugs or alcohol,” said Aurora Police Chief Keith Cross. “This tragic crash that resulted in the loss of someone’s life could have been potentially avoided if someone didn’t get behind the wheel while they were intoxicated.”
The man’s next court appearance is scheduled for April 21, 2022, for arraignment in front of Judge Reidy.
